Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Lead Comply ISO 9001 compliance portal at iso9001.leadcomply.com.au (the "Portal" or the "Service"), operated by Lead Comply (ABN 57 883 606 493, "we", "us").

By creating an account, or by otherwise accessing or using the Portal, you agree to be bound by these Terms. If you are creating an account or using the Portal on behalf of a business or organisation, you confirm that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and that organisation.

If you do not agree to these Terms, please do not use the Portal.

What the Portal does

The Portal helps Australian small and medium businesses prepare for ISO 9001:2026 certification. Depending on your organisation's access level, it may include:

What the Portal is not

Lead Comply does not issue ISO 9001 certification. Certification is granted solely by an independent, JAS-ANZ accredited certification body, through formal Stage 1 and Stage 2 audits conducted by that body. The Portal's purpose is to help you prepare genuinely for that process — organising your documentation, evidence, and readiness — not to replace it.

Using the Portal, including generating and approving documents, completing your readiness assessment, or achieving a high readiness score, is not a guarantee that your business will pass a Stage 1 or Stage 2 audit, or achieve certification. Certification outcomes are determined entirely by your chosen certification body's independent assessment.

The Portal is a business tool. It does not provide legal, financial, engineering, work health and safety, or other professional advice specific to your circumstances, and nothing in the Portal should be relied on as such. Where your business has specific regulatory, safety, or legal obligations beyond ISO 9001, you should seek advice from an appropriately qualified professional.

Eligibility and your account

You must be at least 18 years old and have the legal authority to act on behalf of the business or organisation you register, to create an account.

You are responsible for the accuracy of the information you provide when creating and maintaining your account and organisation profile, and for keeping your login credentials secure. You are responsible for all activity that occurs under your account, including actions taken by team members you invite.

If you invite other people to join your organisation's account, you are responsible for ensuring they are aware of, and agree to, these Terms before they use the Portal.

Business verification

The Portal offers a feature to verify your business against the Australian Business Register (ABR), using your business name or ABN. Verification is optional and does not affect your ability to use core features of the Portal. Where a business cannot be automatically verified, Lead Comply may follow up manually before certain features are unlocked. Lead Comply reserves the right to request further information to confirm your business's identity, and to limit or refuse access to the Portal where we reasonably believe the information provided is false, fraudulent, or misleading.

Free access and engaged accounts

Core features of the Portal are currently available free of charge. Certain features — including inviting team members, generating documents beyond an initial free document, exporting documents, and running the full non-conformance, internal audit, and roadmap planning workflows — may require your organisation's account to be manually marked as "engaged" by Lead Comply, typically following a genuine consultation conversation with our team. This is a deliberate part of how we work with businesses, not an automated or self-service upgrade, and Lead Comply has discretion over when an account is marked as engaged.

Lead Comply may change which features are available at each access level at any time, and will make reasonable efforts to communicate significant changes.

Your content

You retain ownership of the content you create, upload, or generate within the Portal, including your organisation's documents, assessment answers, NCR and audit records, and any other data you input ("Your Content").

By using the Portal, you grant Lead Comply a licence to host, store, process, and display Your Content as necessary to provide the Service to you, including sending relevant portions of it to third-party service providers described in our Privacy Policy (such as Anthropic, for AI-assisted features).

You are responsible for Your Content, including its accuracy and legality, and for ensuring you have the right to submit it. You must not upload content that is unlawful, infringes someone else's rights, or that you do not have the right to share.

Aggregated and de-identified data. Lead Comply may use data derived from your use of the Portal in an anonymised and aggregated form — meaning it does not identify you or your organisation — to understand how the Service is used and to improve it, including improving the quality of AI-assisted features. We will not use Your Content in an identifiable form for this purpose without your consent.

Artificial intelligence features

The Portal uses artificial intelligence to help generate draft documents, audit checklist questions, and chat responses, as described further in our Privacy Policy.

AI-generated content is a starting draft, not a finished or verified output. It is your responsibility, and the responsibility of the appropriate person within your organisation, to review, edit, and approve any AI-generated content before it is relied upon, released, or used as evidence for certification purposes. Lead Comply does not warrant that AI-generated content is accurate, complete, or compliant with ISO 9001:2026 or any other standard, law, or regulation applicable to your business.

The Portal does not use AI to make or significantly influence decisions about individuals that affect their legal rights, finances, or access to services or opportunities. Our AI features are limited to generating draft business documents for your own organisation's use, and answering questions about your own organisation's compliance data.

Team members and roles

The Portal allows an organisation's administrator to invite team members and assign them roles with different levels of access. Each organisation is responsible for managing its own team, including who is invited, what role they are assigned, and removing access when appropriate (for example, when someone leaves the organisation).

Intellectual property

The Portal, including its software, design, and underlying technology, is owned by Lead Comply or its licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms grants you any ownership interest in the Portal itself.

If you provide feedback or suggestions about the Portal, you grant Lead Comply an unrestricted, royalty-free licence to use that feedback for any purpose, without any obligation to you.

Fees

Access to the core features of the Portal is currently provided free of charge. Lead Comply may separately offer paid advisory or consulting services outside the Portal; any such engagement is governed by a separate agreement or quote, not these Terms.

Lead Comply reserves the right to introduce fees for the Service, or specific features of it, in the future. If we do, we will give you reasonable notice before any fees apply to your account, and you may choose to stop using the affected features or close your account rather than pay.

Availability and support

We aim to keep the Portal available and functioning correctly, but we do not guarantee uninterrupted or error-free operation. The Portal may be unavailable from time to time for maintenance, updates, or reasons outside our control.

Suspension and termination

You may stop using the Portal and close your account at any time.

We may suspend or terminate your access to the Portal, in whole or in part, if we reasonably believe you have breached these Terms, engaged in fraudulent or misleading conduct, or if we reasonably believe suspension is necessary to protect the security or integrity of the Portal or other users. Where practical and where the situation does not involve a serious or urgent risk, we will attempt to give you notice first.

On termination, your right to access the Portal ends. We will handle any data associated with your account in line with our Privacy Policy and our data retention practices described there.

Disclaimers

To the maximum extent permitted by law, the Portal is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted, or modified.

Limitation of liability

To the maximum extent permitted by law, and subject to the section above, Lead Comply excludes all liability for any indirect, special, or consequential loss arising from or in connection with your use of the Portal, including loss of profits, loss of business opportunity, or failure to achieve or maintain ISO 9001 certification.

Nothing in this section limits any liability that cannot lawfully be limited or excluded under the Australian Consumer Law or other applicable law.

Indemnity

You agree to indemnify and hold Lead Comply harmless against any claims, losses, or expenses arising from your breach of these Terms, your misuse of the Portal, or Your Content, except to the extent caused by Lead Comply's own breach of these Terms or negligence.

Changes to these Terms

We may update these Terms from time to time to reflect changes to the Portal or our legal obligations. Where changes are significant, we will make reasonable efforts to notify you. The "last updated" date at the top of this page shows when these Terms were last revised. Continued use of the Portal after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.

General

If any part of these Terms is found to be unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lead Comply regarding your use of the Portal.
